The Company director further wrote, "It is not about settling the rupees 2.38 lakh. The contention was about refusing to be exploited in the attempts to fabricate ..Anyway that’s all I can say for now."
As per the reports, Ram Gopal Varma has been found guilty under Section 138 of the Negotiable Instruments Act. This Act ‘penalises cheque dishonour due to insufficient funds or exceeding the account’s arranged amount’. Reportedly, in addition to the jail sentence, RGV will also have to pay Rs 3.75 lakh to compensate the complainant and if he fails to do so in three months, he will be rewarded with an additional three months imprisonment.
A complaint was filed by a company named Shree through Maheshchandra Mishra in 2018 against RGV’s firm, alleging that a cheque issued by Varma had bounced due to insufficient funds. In June 2022, Varma was granted bail after providing a personal bond as well as a Rs 5000 security deposit. The magistrate clarified there would be no ‘set-off under Section 428 of the Code of Criminal Procedure’ as RGV was ‘not in custody during trial’.
